Probate And Administration

If an estate consists of assets which, individually, are less than £5,000 in value, or jointly owned assets where the surviving joint owner automatically inherits the deceased’s share, it may be possible to administer the estate without obtaining a grant of representation (probate or letters of administration). 

Where a grant of representation is required, a personal representative will have to deal with the following matters:-

  • Find out if there is a Will or not, and confirm if he or she is the named executor or, in the absence of a Will, the administrator
  • Attend to formalities such as organising the funeral, securing the property, notifying the registrar
  • Find out the nature and value of assets and debts of the estate
  • Prepare a detailed list of the assets and debts
  • Open an executor’s bank account in order to be able to pay money in and out during the administration
  • Work out the amount of Inheritance Tax payable, if any and arrange payment
  • Prepare and send off the documents required by HM Revenue & Customs and the Probate Registry
  • Swear the papers at the Probate Registry
  • Receive the grant of representation and send copies to all asset holders
  • Collect in all the assets due to the estate and pay any debts
  • Pay out the legacies and hand over any bequests
  • Distribute or invest the residue in accordance with the Will or rules of intestacy
